Mortgage Fraud Scheme

Ten people were charged today with conspiracy, wire fraud and money laundering for their alleged involvement in a mortgage fraud scheme which resulted in lender funding of more than $10 million in mortgage loans.

Dana Merritt, aka Dana Hayden, Stacey Jones, Abigail Gonzalez, Leticia Miffleton, Sharlo Burris, Kendrick Green, Johnese Zeigler, Andre Simon, Gordon Simon and Catherine Wheeler are charged in an 18-count indictment.

According to court papers, Jones, Merritt and Gonzalez operated two El Cajon-based companies, Advanced Partnership Properties and BYW Construction.

The indictment alleges that Jones, Merritt and Gonzalez processed fraudulent loan applications for the other seven defendants to purchase multiple properties located within the Southern District of California and elsewhere.

Specifically, the defendants submitted applications which misrepresented the borrower's intention to occupy the property, place of employment, income and assets, so they could qualify for mortgage funding on each of the properties, the indictment alleges.

The defendants and their co-conspirators would then divert tens of thousands of dollars per transaction from the loan proceeds to BYW's bank accounts using false claims for unsecured loans, liens and notes on construction work that was never performed, prosecutors allege.

After funneling the payments to BYW's bank accounts, the defendants had the funds withdrawn or transferred to their own bank accounts for their own benefit, according to the indictment.

A motions hearing was set for May 18.

Missing Woman

The search for a missing 22-year-old North County military wife who disappeared last week under suspicious circumstances will resume at daybreak, while the last person known to have seen her remains jailed on a weapon charge, authorities said.

Brittany Killgore was last seen in the Fallbrook area by a friend about 5 p.m. Friday, according to the San Diego County Sheriff's Department.

Investigators believe that Killgore, who lived in Fallbrook and whose estranged husband, Cory, is a Camp Pendleton Marine deployed in Afghanistan, was with 45-year-old Louis Ray Perez, also a Camp Pendleton Marine, just before she went missing, sheriff's homicide Lt. Larry Nesbit said.

"Based on our investigation to this point, we believe there is a strong likelihood Brittany is the victim of foul play," Nesbit said.

On Monday, the Sheriff's Department deployed its search-and-rescue units to assist in locating Brittany. Search efforts are centered on the area of De Luz Canyon, north of Fallbrook, the lieutenant said.
